Exclusion of Liability

World Marketing Group shall not be liable for:

i. any indirect or consequential loss or damage, including but not limited to loss of profits, loss of goodwill, and loss of reputation

ii. any delay, loss or damage arising from or in connection with:

a. its failure to perform any of its obligations if such failure is the result of circumstances outside its control, including but not limited to fires, floods, explosions, acts of God, acts of war, acts of terrorism, governmental regulations, or any other similar cause beyond the reasonable control of World Marketing Group;

b. any defect in the Article; or

c. any act or omission by anyone other than World Marketing Group; and

iii. any delay or non-delivery of a parcel arising from the detention or confiscation of the parcel by the customs or any competent authority. In any event, World Marketing Group's liability for any damage, losses, or any cause of action arising out of or relating to these Terms and Conditions shall not exceed the lesser of

i. the sum of the reasonable value of the Article to which the claim relates, and

ii. [S$60].

Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of Singapore, and, subject to clause 11.2, the parties submit to the exclusive jurisdiction of the courts of the Republic of

Singapore to settle any claim, dispute or matter of difference which may arise out of or in connection with these Terms and Conditions.

If any dispute arises with World Marketing Group under or in relation to these Terms and Conditions it shall first be referred to World Marketing Group. If the parties are unable to resolve the dispute within 20 days of referral, then such dispute shall be referred to and finally resolved by arbitration in Singapore in accordance with the SIAC Rules for the time being in force which rules are deemed to be incorporated by reference in this clause. The Tribunal shall consist of one arbitrator to be jointly appointed by the Parties and if the parties fail to agree on the appointment, by the President of the Court of Arbitration of the SIAC. The language of the arbitration shall be English. Nothing in this clause prevents a Party from seeking urgent or similar interim relief from a court of competent jurisdiction.

General Provisions

World Marketing Group has the right to change or add to these Terms and Conditions at any time, and to change, delete, discontinue, or impose conditions on use of the Service by posting such changes on the World Marketing Group website at www.worldmarketing-group.com or any other website World Marketing Group maintains or owns. World Marketing Group may provide the Client with notice of any changes through the World Marketing Group website, via email, or through other means. The Client's use of the Service after a change has taken effect constitutes his/her acceptance of the modified Terms and Conditions. The Client can access a copy of the current Terms and Conditions on the World Marketing Group website at any time. The Client can find out when the Terms and Conditions were last changed by checking the “Last Updated” date at the bottom of these Terms and Conditions.

The Client may not assign these Terms and Conditions or any rights or licences granted in these Terms and Conditions to others without World Marketing Group's prior written consent. World Marketing Group may assign these Terms and Conditions without the Client's consent or any other restriction.

Except as expressly stated in these Terms and Conditions, nothing in these Terms and Conditions serves to establish a partnership, joint venture, or other agency relationship between World Marketing Group and the Client. Neither World Marketing Group nor the Client has the ability to bind the other party to any contract or obligation, and neither party will represent that World Marketing Group or the Client has such an ability.

Neither party will be liable for any delays in processing or other non-performance caused by telecommunications, utility, failures, or equipment failures; labour strife, riots, war, or terrorist attacks; non-performance of our vendors or suppliers, fires or acts of nature; or any other event over which the respective party has no reasonable control.

These Terms and Conditions and all policies and procedures that are incorporated by reference constitute the entire agreement between World Marketing Group and the Client for provision and use of the Service. Except where expressly stated otherwise in writing executed between World Marketing Group and the Client, these Terms and Conditions will prevail over any conflicting policy or agreement for the provision or use of the Service.
